1. Introduction

Welcome to Bitakijo Online Marketplace , operated by TAKIJO TECHNOLOGIES HOLDINGS LIMITED ("Bitakijo," "we," "us," or "our").

These General Terms and Conditions ("Terms") govern your access to and use of the Bitakijo Online Marketplace platform available at bitakijo.takijo.com .

By accessing, registering for, browsing, or using the platform, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

2. About Bitakijo Online Marketplace

Bitakijo is a digital marketplace platform that connects buyers, users, sellers, vendors, and businesses. Vendors can display products and services, while users can browse listings, communicate with vendors, and make their own purchasing decisions.

Bitakijo is a marketplace platform and is not the seller, manufacturer, supplier, delivery provider, or owner of products listed by independent vendors unless expressly stated otherwise.

Unless specifically stated, Bitakijo does not sell products on behalf of vendors, act as their agent, process or hold purchase payments, guarantee product quality or availability, guarantee delivery, or guarantee successful completion of transactions.

3. Acceptance of These Terms

By using Bitakijo, you confirm that you have read and understood these Terms, agree to comply with them and applicable laws, and accept responsibility for your activities on the platform.

If you use Bitakijo on behalf of a business or organization, you confirm that you have authority to accept these Terms on its behalf.

4. Eligibility

You must be at least 18 years old to create and operate an account on Bitakijo, unless applicable law permits otherwise or the account is operated with the involvement and authorization of a parent or legal guardian.

5. User Accounts

When creating an account, you agree to provide accurate, complete, and current information; keep your information updated; protect your credentials; not share credentials with unauthorized persons; and promptly notify Bitakijo of suspected unauthorized access.

You must not create an account using false information or impersonate another individual, company, or organization.

6. Vendor Responsibilities

Vendors are independently responsible for products and services they list on Bitakijo, including:

• Accuracy and completeness of listing information.
• Product and service availability.
• Pricing and applicable charges.
• Product quality and safety.
• Descriptions, images, videos, and specifications.
• Compliance with applicable laws and regulations.
• Delivery arrangements and fulfillment.
• Applicable warranties and guarantees.
• Customer communication and support.
• Ensuring listings do not infringe third-party rights.

7. Buyer and User Responsibilities

Users and buyers are responsible for exercising reasonable care and conducting appropriate due diligence before entering into a transaction or agreement with a vendor.

Before purchasing or making a payment, users should independently verify product or service details, vendor information, pricing, availability, delivery arrangements, warranties, and other information relevant to the transaction.

8. Transactions Between Users and Vendors

Bitakijo provides a platform through which users and vendors may discover one another and communicate. Unless expressly stated otherwise, Bitakijo is not a party to the contract or transaction between a buyer and a vendor.

The buyer and vendor are responsible for agreeing on product or service terms, price, payment method, delivery, returns, refunds, warranties, and other transaction-specific conditions.

9. Payments

Unless a particular Bitakijo service expressly states otherwise, Bitakijo does not process, receive, hold, or transfer purchase payments between buyers and vendors.

Users should exercise caution when sending money directly to vendors. Bitakijo is not responsible for payment arrangements made directly between users and vendors, except where liability cannot lawfully be excluded.

10. Communication

Bitakijo may provide communication or messaging functionality to facilitate interaction between users and vendors.

You must not use the platform to send spam, threats, abusive communications, harassment, fraudulent information, malicious software, harmful content, or illegal material.

11. Prohibited Activities

Users and vendors must not use Bitakijo to:

• Publish false, misleading, or fraudulent information.
• Sell or promote illegal or prohibited products or services.
• Impersonate another person, company, or organization.
• Commit or facilitate fraud.
• Upload malware, viruses, or harmful software.
• Attempt unauthorized access to Bitakijo systems or accounts.
• Interfere with platform operation or security.
• Violate intellectual property or other legal rights.
• Abuse automated systems or scrape the platform without authorization.
• Harass, threaten, or abuse other users.

12. Product Listings and Content

Vendors are responsible for content they upload or publish, including product names, descriptions, prices, images, videos, specifications, contact information, and business information.

Vendors must have the necessary rights and permissions to publish their content. Bitakijo may remove, restrict, modify, or disable listings that violate these Terms, applicable law, or platform policies.

13. Intellectual Property

The Bitakijo platform and its original content, features, software, design, graphics, logos, trademarks, text, layout, and other materials are owned by or licensed to TAKIJO TECHNOLOGIES HOLDINGS LIMITED , unless otherwise stated.

You may not copy, reproduce, redistribute, modify, reverse engineer, or misuse platform content or branding without authorization, except where permitted by applicable law.

14. User-Generated Content

Where Bitakijo allows users or vendors to upload content, you remain responsible for the content you submit and confirm that you have the necessary rights to submit it and that it does not unlawfully infringe another person's rights.

You grant Bitakijo permission to host, display, reproduce, format, and distribute submitted content as reasonably necessary to operate, maintain, and promote the platform, subject to applicable law.

15. Platform Availability

We aim to keep Bitakijo available and reliable, but do not guarantee uninterrupted, error-free, vulnerability-free, or universally compatible operation. The platform may be unavailable because of maintenance, technical problems, network failures, security issues, third-party services, or circumstances beyond our reasonable control.

16. Disclaimer

To the maximum extent permitted by applicable law, Bitakijo does not guarantee the accuracy of vendor listings, quality, safety, authenticity, legality, vendor reliability, product availability, delivery, fulfillment, successful completion of transactions, or that products and services will meet a user's particular expectations.

Users and vendors are responsible for their own decisions and interactions on the platform.

17. Third-Party Services and Links

Bitakijo may contain links, integrations, or references to third-party websites, applications, payment providers, communication services, or other external services. Such services may have their own terms and privacy policies. Bitakijo is not responsible for third-party services except where otherwise required by applicable law.

18. Reporting Misconduct

Users and vendors are encouraged to report suspected fraudulent listings, illegal products or services, scams, abusive behavior, impersonation, intellectual property violations, security issues, and other violations. Bitakijo may investigate and take appropriate action.

19. Account Suspension or Termination

Bitakijo may suspend, restrict, or terminate an account where we reasonably believe that the account has violated these Terms, been involved in fraudulent or unlawful activity, created a security or operational risk, provided materially false information, or must be restricted under applicable law.

20. Limitation of Liability

To the maximum extent permitted by applicable law, TAKIJO TECHNOLOGIES HOLDINGS LIMITED and Bitakijo shall not be responsible for losses arising from transactions or interactions between users and vendors, including fraud, product defects, delivery disputes, payment disputes, vendor or buyer misconduct, incorrect information, third-party services, or indirect, incidental, special, or consequential losses.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

21. Indemnification

To the extent permitted by applicable law, users and vendors agree to be responsible for claims, losses, liabilities, damages, costs, or expenses arising from their violation of these Terms, violation of applicable law, misuse of the platform, fraudulent or unlawful activities, submitted content, or infringement of another person's rights.

22. Privacy and Personal Information

Your use of Bitakijo may involve the collection and processing of personal information. Personal information will be handled in accordance with Bitakijo's applicable Privacy Policy and relevant data-protection laws. Where applicable, the Privacy Policy forms part of these Terms.

23. Changes to These Terms

We may update these Terms from time to time. The updated version will be published on the Bitakijo platform together with an updated effective date where appropriate. Continued use after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

24. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of the United Republic of Tanzania .

If a dispute, claim, misunderstanding, or disagreement arises out of or relates to Bitakijo, these Terms, or the services provided through the platform, the parties should first attempt to resolve the matter through good-faith communication and negotiation.

Where the matter cannot reasonably be resolved through internal discussions, it may be referred to a competent authority, tribunal, or court having jurisdiction under the applicable laws of the United Republic of Tanzania.

25. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it enforceable where legally possible. The remaining provisions shall continue to apply.

26. Entire Agreement

These Terms, together with any additional policies or terms expressly incorporated into them, constitute the agreement governing your use of Bitakijo, except where a separate written agreement applies.
